1. Who we are
Varsify ("Varsify", "we", "us" or "our") is building a platform to help learners, students, schools and businesses connect around education and early-talent opportunities. At this stage, we are operating a waitlist and related early access communications. These Terms of Service ("Terms") govern your access to and use of our website and waitlist in this early phase (together, the "Services").
2. Acceptance of these Terms
By accessing or using our website, joining the waitlist or otherwise providing your details to Varsify, you agree to be bound by these Terms and our Privacy Policy. If you are under 18, you confirm that you have obtained the consent of your parent or legal guardian to share your personal information with us for the waitlist.
If you are providing details on behalf of another person (for example, as a parent, guardian or school representative), you represent that you are authorised to do so and that you will ensure that they are made aware of these Terms and our Privacy Policy.
3. What the waitlist is (and is not)
The current Varsify waitlist allows you to register your interest in the future Varsify platform and to receive updates and early access information. Joining the waitlist does not:
- create any obligation on Varsify to provide specific services, bursaries, placements or opportunities; or
- guarantee that you will be granted access to any beta, trial or full version of the Varsify platform.
Any future functionality, including detailed application tools, bursary matching and business recruitment features, will be governed by updated terms and additional documents, which will be made available at the relevant time.
4. Your responsibilities
- You must provide information that is truthful, current and complete when you join the waitlist or contact us, and update it if it changes.
- You may not use our website or waitlist to upload unlawful, offensive or infringing content, or to harass, discriminate against or harm others.
- You may not attempt to reverse engineer, interfere with, overload or disrupt the website or our systems, or circumvent any technical protections we use.
5. Data protection and privacy
Varsify processes personal information in accordance with POPIA and other applicable South African data protection laws. Our practices for the waitlist stage are set out in our Privacy Policy, which forms part of these Terms.
By joining the waitlist, you acknowledge that we will use your contact and profile information to communicate with you about Varsify and to understand interest in our future services, as described in the Privacy Policy.
6. Intellectual property
All rights, title and interest in and to the website and any content we provide (excluding user-submitted content) are owned by or licensed to Varsify and are protected by South African and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the website and waitlist solely for their intended purposes and in accordance with these Terms.
If you submit feedback, ideas or suggestions about Varsify, you agree that we may use that feedback without restriction or obligation to you.
7. Disclaimers
The waitlist and website are provided on an "as is" and "as available" basis. While we aim to provide accurate information, we do not guarantee that the website will be error-free or uninterrupted, or that particular features or services will be developed or made available in future.
To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of fitness for a particular purpose, merchantability and non-infringement.
8. Liability
To the extent permitted by South African law, Varsify, our directors, employees and partners will not be liable for any indirect, consequential, special or punitive damages, or for any loss of profits, revenue, data or opportunities arising out of or in connection with your use of the website or waitlist.
If we are found to have any direct liability to you, our total aggregate liability for all claims will be limited to a reasonable amount permitted under applicable South African law.
9. Suspension and termination
We may suspend or remove your details from the waitlist or restrict your access to the website at any time where we reasonably believe that you have breached these Terms, misused our systems or engaged in fraud, abuse or conduct that may harm Varsify or other users. Where reasonable, we will give you prior notice of suspension or removal.
10. Changes to the Services and these Terms
We may update or change the website, waitlist and these Terms from time to time, for example to reflect changes in law or in our plans for the Varsify platform. When we make material changes, we will provide reasonable notice, which may include posting an updated version on our website with a new "Last updated" date. Your continued use of the website or participation in the waitlist after changes take effect constitutes your acceptance of the updated Terms.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or relating to these Terms or the website and waitlist will be subject to the jurisdiction of the courts of South Africa, subject always to any mandatory rights you may have under consumer protection laws.
